WHAT IS FAMILY-BASED IMMIGRATION?
Family-based immigration is one of the most personal and powerful ways individuals can obtain lawful status in the United States. It allows U.S. citizens and lawful permanent residents (green card holders) to sponsor certain family members to come live, work, and build a future in the U.S. legally.
While the process may seem straightforward, it’s filled with critical legal steps, government forms, and strict eligibility requirements. Even minor mistakes or missing documents can delay or jeopardize a case. That’s why having a trusted immigration attorney by your side can make all the difference.
Beyond paperwork, this process is deeply emotional. It’s about bringing families back together — spouses, children, parents, and siblings — and helping them start new lives on American soil.
Family-based immigration allows U.S. citizens and lawful permanent residents to sponsor family members for a green card. It’s one of the most common—and most personal—paths to lawful status in the U.S.
WHO CAN YOU SPONSOR?
Depending on your immigration status (U.S. citizen or green card holder), there are different family members you may be eligible to sponsor:
Immediate Relatives of U.S. Citizens
- Spouse
- Unmarried children under 21
- Parents (if the sponsor is 21 or older)
Family Preference Categories
- Unmarried sons and daughters (21 and over) of U.S. citizens
- Spouses and children of green card holders
- Married sons and daughters of U.S. citizens
- Brothers and sisters of U.S. citizens (if the sponsor is 21 or older)
THE APPLICATION PROCESS
The family-based immigration process begins with filing Form I-130 to establish a qualifying family relationship. Once approved by USCIS, the next steps depend on whether the relative is inside or outside the U.S. Those already in the country may apply for Adjustment of Status, while those abroad go through Consular Processing at their local U.S. embassy. The process includes submitting supporting documents such as medical exams, birth or marriage certificates, and affidavits of support, followed by an immigration interview to verify the relationship. If successful, the relative is granted a green card or immigrant visa. However, the process can be complex, time-sensitive, and document-heavy — which is why having an experienced immigration lawyer by your side can make all the difference.
